By using our website, you accept these terms and conditions in full. If you disagree with any part of these terms and conditions, do not use our website.

  1. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise stated, 3rg Associates Ltd. or our licensors own the intellectual property rights in the website and material on the website. Subject to the licence below, all these intellectual property rights are reserved. Both 3rg Security & 3rg Security Training are trading names of 3rg Associates Ltd.

  1. LICENCE TO USE WEBSITE

You may view, download for caching purposes only, and print pages from the website for your own personal use, subject to the restrictions below. You must not:

  • republish material from this website (including republication on another website);
  • sell, rent or otherwise sub-license material on the website;
  • reproduce, duplicate, copy or otherwise exploit material on our website for a commercial purpose;
  • edit or otherwise modify any material on the website; or

However, nothing in these terms and conditions shall exclude or limit our liability for fraud, for death or personal injury caused by our negligence, or for any other liability which cannot be excluded or limited under applicable law.

Access to certain areas of our website is restricted. We reserve the right to restrict access to areas of our website, or indeed our whole website, at our discretion.

If we provide you with a user ID and password to enable you to access restricted areas of our website or other content or services, you must ensure that that user ID and password is kept confidential. You accept responsibility for all activities that occur under your user ID or password.

We may disable your user ID and password, at our sole discretion, OR if you breach any of the policies or terms governing your use of our website or any other contractual obligation you owe to us.

  1. BULLETIN BOARD / CHAT ROOM / COMMENTS

You must not use our website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website.

You must not use our website in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity. You must not use our website for any purposes related to marketing without our express written consent.

You must not use our website to copy, publish or send mass mailings or spam. You must not use our website to copy, publish or send material which is illegal or unlawful, or material which could give rise to legal action under English and other applicable law. All material you copy, publish or send via our website must not be defamatory, obscene, indecent, hateful, discriminatory or inflammatory; such material must not infringe any person’s intellectual property rights or rights of confidence, impinge upon any person’s privacy, or constitute incitement to commit a crime; further, material must not be misleading, deceptive, sexually explicit, threatening, abusive, harassing or menacing.

We reserve the right to edit or remove any material posted upon our website. We may take such action as we deem appropriate to deal with the posting of unsuitable material, including suspending or cancelling your account, restricting your access to our website, or commencing legal proceedings against you.

In respect of all material that you post on our website, you grant to us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate and distribute such material in any media, together with the right to sub-licence such rights.

We may revise these terms and conditions from time-to-time. Please check this page regularly to ensure you are familiar with the current version.

  1. ENTIRE AGREEMENT

These terms and conditions, together with our privacy policy, constitute the entire agreement between you and us in relation to your use of our website, and supersede all previous agreements in respect of your use of this website.

  1. LAW AND JURISDICTION

These terms and conditions will be governed by and construed in accordance with English law, and any disputes relating to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England.

 3RG SECURITY

  1. EMPLOYING 3RG SECURITY

By employing 3rg security services by way of contract, sub-contract or any other means, you agree to pay the invoice in full within 30 days of the ‘Tax date’ indicated on the 3rg invoice including any tax or VAT added at the current rates.

We understand and will exercise our statutory right to claim interest and compensation charges under the Late Payment of Commercial Debts [Interest] Act 1998 (as amended and supplemented by the Late Payment of Commercial Debts Regulations 2002) if payment is not received in accordance with our agreed terms of payment.

Current Interest rate is 8.5% Compensation Fees relate to the amount outstanding = Up to £999.99 incurs £40 fee, £1000 – £9999.99 incurs £70 fee & £10000 or over incurs £100 fee.

Daily rates will be agreed before the 3rg security services commence either in writing or verbally which must be paid in full along with any expenses incurred.

3RG TRAINING

  1. CONTRACT:

Your contract is with 3rg, and the following terms and conditions will be incorporated into every contract for both yourself (the Client) and all members named on the booking form.  By making a deposit, full payment or for late bookings stating by some means (email) the clients intention to attend and pay cash for 3rg services, the client will be accepting the terms and conditions. English Law governs the contract and you agree to submit to the jurisdiction of the English courts.

You Agree to Indemnify Us: You agree to indemnify and hold us and our Directors, Employees, Agents and Instructors (as applicable) harmless from and against any claim, damages, proceedings, losses and damages of every kind and nature, including solicitors’ fees, made by any third party due to or arising out of your breach of this agreement or the terms and policies it incorporates by reference, or your violation of any laws or the rights of third parties.

  1. RESERVATION OF YOUR SELECTED COURSE(S):

Your course will be reserved for you as per the booking procedure. If the minimum number of participants (4) is not met, then you will be notified 48 hours prior to commencement of the course and requested to book another date. 3rg reserves the right to postpone / cancel any course if a minimum of 4 participants is not met.

  1. COURSE PAYMENTS:

DEPOSITS – A non-refundable deposit of £250.00 is required to secure a booking for:

  • Medical / First Aid courses
  • Surveillance / Professional Investigators course
  • Close Protection Operatives course
  • Any other courses / packages offered by 3rg

Payment of a deposit or in full confirms that you agree to the terms and conditions set out by 3rg. Where a course costs less than £400 in total, a full non-refundable payment will be required at the time of booking.

OUTSTANDING BALANCE – Payment of the outstanding balance is due fourteen days before attending the course. If the booking is within fourteen days of the course start date, the full amount must be paid at the time of booking.  In the event of the final payment being late (not received before fourteen days before the course stat date) 3rg reserves the right to cancel the course place and the initial minimum deposit of £250.00 will not be refunded. 3rg reserve the right to subject a 10% service charge for late payment/overdue accounts.

ENHANCED LEARNING CREDITS COURSE PAYMENTS – Students claiming Enhanced Learning Credits (ELC) will pay a non-refundable deposit of 20% for all approved ELC courses under ELC terms and conditions. Where the 20% deposit and ELC claim amount does not cover the full course costs then the remainder must be paid in full fourteen days before the course commences.

CERTIFICATES

Certificates are usually dispatched by 3rg within 72 hours, once 3rg has received certificates from the awarding organisation. Most awarding bodies will dispatch certificates within 10 working days of the course completion. If you do not receive certification within 14 days of course completion, please email training@3rg.co.uk .

REPLACEMENT CERTIFICATES – replacement certificates will be charged at cost stipulated by the awarding organisation, plus a 3rg administration fee of £25 per item.

Please note – Awarding organisation certificate replacement costs vary depending on the type of course and are subject to change, in which case we reserve the right to charge the fee applicable at the time we receive your lost certificate notification.

PRICE GUARANTEE – Once booked, the price of your course / package is guaranteed unless the awarding organisation changes the course specification which may incur further charges.

All fees are correct at the time of publishing but may be subject to change, in which case we reserve the right to charge the fee applicable at the time we receive your reservation.

  1. JOINING INSTRUCTIONS:

Upon receipt of a deposit or full payment, 3rg will issue a set of comprehensive joining instructions via email.

  1. COURSE DATE AMENDMENTS:

Once a deposit or full payment is made then students / clients may amend their course date to a future programmed like for like course as long as the amendment is made in writing at least fourteen days before the initial course start date. Course amendments made thirteen days or less from the original course start date will be subject to a 10% administration fee. Please note course date amendments may be subject to price increases if price increases have occurred during the amended dates.

  1. COURSE CANCELLATION:

Course cancellations received by 3rg will incur the following administration charges:

  • 28 days prior to the course start date will incur a 25% administration charge
  • 8-14 days prior to the course start date will incur a 50% administration charge
  • 7 days or fewer prior to course or non-attendance will incur the loss of the total course fee.

Where the percentage fee is less than £250 a minimum amount of £250 will apply.

All cancellations have to be submitted in writing via email to training@3rg.co.uk . The cancellation date will be set as the date that 3rg receives the written cancellation via email. Phone call cancellations must also be followed up by a confirmation email sent to training@3rg.co.uk .

If the original course date is amended by the client/student to a later date, then subsequently cancelled, no deposit or full payment refund will be applicable as outlined in course cancellations above.

  1. PROGRAMME CHANGES:

3rg reserves the right to cancel and/or amend course dates, times and content. Where possible, you will be notified via phone call or email of cancellations or amendments. In circumstances beyond 3rg’s control, a course may have to be cancelled at short notice. In such cases 3rg will endeavour to arrange suitable alternatives or refund the client/student the full course fee only. No additional client/student costs will be reimbursed, such as but not limited to travel, accommodation, subsistence or lost income.

All modules of all courses must be attended; therefore 3rg reserves the right to refuse course entry to late arrivals at the beginning or during the course duration. Your own insurance is recommended to cover such issues mentioned in this section.

  1. UNACCEPTABLE BEHAVIOUR:

We reserve the right to cease providing services to you if any terms and conditions or wilful damage to property takes place. In such cases, our contractual obligations with you and your party will cease. You will be liable for any civil or criminal actions and your booking will be treated as having been cancelled by you and be liable for any fees owed. If we cease to provide our service to you because of your unacceptable behaviour no monies will be returned under any circumstances. 3rg reserves the right to withdraw any contractual services at any time without notice. For further information please consult the 3rg Malpractice Policy, available to paying students located at 3rg Security Training Centre – Poole, Dorset.

  1. COMPLAINTS:

In the event of any concerns or complaints, please contact a member of the 3rg team at the time. We would actively seek to resolve any issues you may have at the time. If you cannot obtain satisfaction, please write to us at 3rg within 14 days of return by recorded delivery. Please be assured that any complaints received will be acted on immediately.

  1. MEDICAL:

The Client/Student is asked to disclose any medical history or problems, which are likely to affect their physical or mental wellbeing during the course.  This does not necessary mean that the Client/Student will be refused a position on the course, but 3RG would like to make provision to accommodate that condition if possible.  The Client should confirm to the best of their knowledge they are not suffering from a heart condition, angina, epilepsy, diabetes, giddy spells, asthma, back problems or any other form of disability either physical or mental.  If there is any doubt by the Client about their medical wellbeing and fitness, you should seek your GPs advice.

  1. EQUIPMENT AND CLOTHING:

Where appropriate you may be requested to provide equipment and clothing for use during the training.  This is done so at your own risk, 3rg are not responsible for the cleaning, servicing, repair, replacement of such clothing and/or equipment.

  1. DATA PROTECTION ACT – GDPR:

Data will not be shared with third parties for marketing or commercial purpose without first obtaining your explicit consent.

  1. WEBSITE COOKIES:

Please be aware the visiting the 3rg website may involve the use of cookies – During the course of any visit to the 3rg website, the pages you see, along with a cookie, are downloaded to your device. Many websites do this, because cookies enable website publishers to do useful things like find out whether the device (and probably its user) has visited the website before. This is done on a repeat visit by checking to see, and finding, the cookie left there on the last visit. By using the 3rg website you confirm that you agree to this data being available to 3rg. Cookies do not contain any information that personally identifies you, but personal information that we store about you may be linked, by us, to the information stored in and obtained from cookies.

  1. DISCLAIMER:

You must read our terms and conditions prior to commencement. The participant’s booking & payment confirms your responsibilities whilst on a 3rg training course and obligations to 3rg with regard to your insurance. You must inform the staff before the commencement of the course if you have any reasons medical or otherwise why you can not to take part.

  1. AMENDMENTS TO TERMS AND CONDITIONS:

We reserve the right to amend this Agreement at any time without notification. Your continued participation following such notification will represent an agreement by you to be bound by the Agreement as amended. Completing any of the courses does not guarantee your employment within any of the subject areas in which 3rg provide.  3RG is not responsible for any injury or incident arising out of the use or misuse of the application of the information contained in the training course or material.
